In the name of God Amen I John Kennedy being sick and weak of body but of sound disposing mind and memory calling to mind the uncertainty of this life and that it is appointed for all men to die do make and ordain this my last Will and Testament in manner and form following. In Primis. I give and bequeath unto my beloved wife Elizabeth H. L. Kennedy (Elizabeth H. S. Kennedy) during her natural life that part of the plantation whereon I now live with the dwelling House and other improvements thereon agreeable to the bounds as here after conveyed to my Son John Kennedy.

I will and bequeath unto my wife Elizabeth H. L. Kennedy (Elizabeth H. S. Kennedy) the following Negro men Elisha, Jim & Robin SMITH and a negro boy by the name of Phill also the following women. Aary, Celia, Ann and Nelly likewise Hellen the Child of Ann and Mary the Child of Nelly, old Jim and his wife Judah, Robin & his wife Phillis all of whom I give to her her Executors, Administrators and assigns forever. I also give and bequeath to her my Horse & Gig, my Hamakan and Telfair Mules and the Cream Colored Mule the stock of provisions on hand and the poultry and my farming utensils.

I will and devise unto my Son John L. Kennedy (John Simpson Kennedy) to take effect upon the death of my wife that part of my plantation whereon I now live with the Houses and other improvements thereon bounded as follows beginning at the Cross fence on the Cypress branch runing thence with the path or roadway to the Gate at or near the Marsh thence with the path or roadway to the Gate at or near the marsh then a direct line to a cypress on the gut that terminates at the island, thence from the cypress to the Eastwardmost branch of a Gut that lies near to and westward of a Canal cut for getting off a Vesel then down the Gut to the River or Creek and with the river and Creek to the mouth of Floyds Creek then with Floyds Creek to the mouth of Cypress branch, then with the Cypress branch to the beginning. I likewise will and devise to him my land north of the old Chapel road lying between deep run and Trotters line and extending to Cherrys line and I will and bequeath to him my book Case and side Board together with my liquor case lined with lead and one bed and bedstead with bed furniture the cream colored mule I purchased of C. HOLLAND and the Gun I bought for him also all of my bridge Stock all of which both real and personal to him his Heirs and assigns forever. I will and devise to my Son Warren E. Kennedy the following tract or parcel of land bounded as follows beginning at John L. (S.) Kennedy's line at the mouth of a gut lying to the westward of the said Canal runing with the said line or lines to the cypress branch thence up the cypress branch to the deep run thence up the deep run to the old Chapel or main road thence with the old Chapel road to TROTTERs line, thence with TROTTERS line to my corner in the Thoroughfare thence with (Hanrahans)HAMAHANS and William Kennedys line to Mount Pleasant Marsh thence so as to include all my land and marsh lying to the Eastward of John L.(S.) Kennedys land, also fifty acres of Land being part of the plantation or land formerly owned by William Cherry all of which I give to him his heirs and assigns forever. I also give to my son Warren E. Kennedy the Grey Mule I purchased of C. HOLLAND the Gun I purchased for him my other liquor Case, one bed and bedstead and bed furniture to him his Executor, Administrators and assigns. I will and devise to my daughter Anne Eliza Kennedy all the Land I purchased of Bazel Floyd and others lying between the deep run Williams's Mill run and the cypress branch to her her heirs and assigns forever, and I will and bequeath to her one small Beaurear, one bed and bedstead with bed furniture and a small work stand to her and her Executors, administrators & assigns forever. I will and devise to my daughters Susan L.(S.) Kennedy and Mary L.(S.) Kennedy all the all the remainder of my Land, and three Lots of Land in Town of Washington, number 27 Ressas Place and number 55 & 59 in Gladdens plan to them their Heirs and assigns forever and will and bequeath to each of them a bed and bedstead and bed

Furniture to them their Executors and administrators and assigns I will and bequeath to my wife all the remainder of my furniture not already given away to her her Executors administrators and assigns and I give her in the same manner all my Hogs. I give and bequeath unto my five Children John, Warren, Ann Eliza, Susan and Mary all the remainder of my Negroes not already given away equally to be divided, to them their exectors, Administrators and assigns respectively, and it is my will and desire that the said Negroes shall not be divided until some of my Children arrives at the age of twenty one Years, or marries his or her part then being taken off the others to remain in common stock until another event of the same kind occurs, when his or her part will be taken off and so in sections until they all arrive at the age of twenty one Years or marries the hiring for their benefit respectively. It is my will and desire that my Stock of cattle and Sheep , my Cotton on hand and my Cotton Crop and part of my Corn Crop be sold to pay my Debts and to raise a fund to maintain & educate my children and I do hereby empower my Executors to convey to William HANRAHAN the Bank Stock I purchased of Joseph Ross HANRAHAN for him. I give and bequeath to my wife out of the crop now growing on the land Land one hundred Barrels of corn to support her and her family and also four Cows & Calves and Ten head of sheep and I do here-by constitute and appoint my friend Bryan GRIMES testamentary Guardian to my five Children and do nominate constitute and appoint my Brother William Kennedy and my friend Richard GRIST Executors to this my last Will and Testament, hereby revoking all others by me heretofore made acknowledging this to be my Last, the Guardianship to remain until my children respectively arrives to the age of Twenty One Years or marries.

I John Kennedy being desirous of making some small alterations in the disposition of my property from what is contained in the above Will do hereby add the following as a codicil thereto, with an intention that it shall be taken and considered as a part of my Will and to not affect the above in any manner otherwise than what is herein expressly mentioned that is to say, I do revoke that part of my Will which gives to my wife the negro boy by the name of Phill, and in lew thereof I do give and bequeathe unto her a negro boy by the name of John ROBINS, to her her Executors, administrators and assigns forever and I do hereby give and bequeath unto my five children, John, Warren, Ann Eliza, Susan and Mary the said boy Phill to them their executors administrators and assigns respectively to be managed in the same manner for their benefit and subject to the same division in every respect as the other negroes given to them in the above Will. I give and bequeath unto my Son John Kennedy my new family Bible, his choice out of my stock of four head of cattle, and it is my will that the Desk on which the book case Stands should go to him with the Case and when he arrives at the age of twenty one Years, I give and bequeath to him my Cotton Gin, the House and shed where it is worked, and the precise spot of Land on which it stands for the use of the Gin together with my wheat fan, but until he arrives at the age of twenty one Years, I give the use of the Gin House shed and Ground on which the House stands, with the wheat Fan to my wife. I give and bequeath to my Son Warren four head of Cattle out of my Stock and I will and bequeath unto my sons John and Warren my Library equally to be divided in value between them, to them their Heirs, Executors, Administrators and assigns respectively. I will and bequeath to my Wife her prayer Book. I will and bequeath unto my Daughter Ann Eliza my Mare and her prayer book to her her executors Administrators and assigns. It is my Will and desire that if either of my three Daughters should die before they arrive at the age of twenty one Years or marries that then their respective parts of the negroes I have given them should go to the survivors or survivor of them my said Daughters their executors Administrators and assigns respectively.

 I, William Kennedy being sick of body but of sound and disposing mind and memory calling to mind the uncertainties of this life and that it is appointed for all men to die, do make and establish this my Last Will and Testament in manner and form following-

 In the first place it is my will and desire after the decent interment of my body that all my just debts should be fully satisfied and paid and as to------- such worldly goods as it has pleased Almighty God to bless me with in this life I will and dispose of as follows-

 I give and bequeath unto my Daughter Frances E. L. Kennedy, (Frances E. S. Kennedy) the following negroes, Patriclus, Peter, Patsey and her five children viz. Brister, William, Wallace, Pam, Seymore, Patsey and Hannah, Maria, Eagworth, Caroline, Louisa and Narcissa, and a bed, bedstead and its necessary furniture to her, her Executors, Administrators and Assigns forever and it is my wish that she should have immediate possession of the above property -

 I give and devise unto my Daughter Frances E. L.(S.) Kennedy, my Pack on Swamp Lands, or in other words all the Lands Down in Bath Town District to her her heirs and assigns forever.

 I give and bequeath unto my Daughter Sophonioba A. L. Kennedy the following Ten negroes, which I have already put in her possession of, Ben, Horace, Eve, Matilda, Maria Louisa, Julius, Jane and her three children viz. Prilir, Latitia and William; also the bed bedstead and furniture she has received to her her Executors, Administrators and Assigns forever -

 I give and devise unto my Daughter Sophorioba A. L. Kennedy My Mills and the Lands thereto belonging in other words all the Land down in Broad Creek District A. her her heirs and Assigns forever.

 I give and bequeath unto my Son William L. Kennedy, the following Ten negroes, which he has in possession - Agrippa, Silvester, Amanda, Octavius, Nancy, and her five children viz David, Brum, Octavia Serena, Aguippa the younger and William Crawford, also the bed bedstead and furniture he has received to him his Executors, Administrators and assigns forever-

 I give and devise unto my Son William L. Kennedy my plantation lying above the Town of Washington and all the Lands formerly owned by Wilson, also I give and devise unto my Son William My Lands lying in the Swamp on Bear Creek and Pamlico River being the same Lands given to me by my father. - All of which above described property, I give and devise unto him his heirs and assigns forever.

 As to all the remainder of my negroes it is my will and desire that they be lent out by my Executors hereafter named until the hire together with the sale of My perishable property, shall amount to a Sum Sufficient to pay all my just debts - After which payment, I will and bequeath the said remainder of my negroes unto my three Children, vz Frances E. L.(S.) Kennedy, Sephonisbor A. L. Kennedy and William L. Kennedy my Bachelor's Hall Lands to be equally divided between them, which I give to them, their heirs, and assigns forever, but it is my wish that the division be so made that the part allotted to William L. Kennedy should be on the west side of said Lands.-

 It is my wish and desire that My old negro Man Brister be emancipated and Set at liberty by my Executors, and should it so happen that he is unable to maintain himself, it is My wish that My Children should be sold for the payment of my debts.-

 I do hereby nominate, constitute and appoint William L. Kennedy and Shadrach R. Allen Executors to this My Last Will and Testament, hereby annulling and revoking all others heretofore made by me.

November Term 1834. Then was the last Will and Testament of William Kennedy dec'd attested by Jno. W. LATHAM and William BRINKLEY and purporting to be Signed by said William Kennedy and dated the 2Oth September 1833, was exhibited into Court by William L. Kennedy and Shadrach P. Allen, the Executors therein named and proved in due form of Law do as to pass both real and personal Estate therein mentioned by the oath of Jno. W. LATHAM and William BRINKLY attesting witnesses thereto - let it be recorded and William L. Kennedy and Shadrach P. Allen the Executors therein named came into Court and qualify.- William ELLISON C.

Whereas William Kennedy late of the county of Beaufort in the State of North Carolina now deceased did by his last Will & Testament bequeath to his son William L. Kennedy and his two daughters Frances E. S. Kennedy wife of George A. Farris and Sophonisba A L Kennedy wife of Shadrack P. Allen certain negro Slaves to be equally divided between them and did also by his last will and Testament and whereas the legatees aforesaid are desirous that the negroes so bequeathed by the said William Kennedy should be fairly and equally divided and distributed to them respectively.

 Now be it Known that the said William L. Kennedy the said George A. Ferris husband of the said Frances E. L. Kennedy and the said Shadrach P. Allen husband of the said Sophonesba A. L. Kennedy in order that such fair & equal distribution may be made to the mutual satisfaction of said parties, do, by these presents Elect chosen & appoint William W. HILL, Thomas H. DAVIS and Joseph E. STICKNEY to be arbitrators for the purpose of making such Division and do mutually agree that the said arbitrators Shall appraise and at their best discretion affix a valuation to each of the said negroes twenty eight in number so to be divided, and Shall then divide the said Negroes into three Lots, as nearly equal as the case may be having relation to their value so affixed, with power to name and decree such and any Sum or Sums of money which it may be necessary should be paid by any one or more allotee or allotters. to any other one - or more a11 three or all others in order to make the said three divisions equal and after such valuation division into lots, and decree for the payment of money as aforesaid. the said arbitrators shall distribute the said divisions to the Several legatees herein named by lot and report their proceedings to said legatees. And the said William L. Kennedy the said George A. Farris and the said Shadrach P. Allen do by these presents, bind & obligate themselves to abide by the decree and award of the said William W. HILL Thomas H. DAVIS and Joseph B. STICKNEY and do agree with each other to carry the same into effect and do Severally agree as follows. Viz, That the said George A. FARRIS upon the receipt of the allotment allotted and decreed to him in right of his wife as aforesaid Shall and will execute to the said William L. Kennedy & Shadrach P. Allen Executors as aforesaid his receipt for the Same thereby releasing, discharging and acquitting them from all claims & demands on account of the negros so bequested to him by the said last will and testament of the said William Kennedy and the said William L. Kennedy and Shadrach P. Allen Executors as aforesaid do agree to deliver the said negros so allotted to him to the said

George A. FARRIS - And the said William L. Kennedy and Shadrach P. Allen do agree to execute & deliver to each other release thereby discharging and acquitting Each the other, from all claims against him for his respective share and deliver each to the other the negroes, so respectively distributed to him. And in Testimony hereof the said William S. Kennedy and the said George A. FARRIS have hereunto Set their hands & seals, as also hath the said Shadrach P. Allen by John G. HARVY his attorney, thereunto fully authorized and Empowered by letter of attorney - under the hand and Seal of the Said Shadrach P. Then was the execution of the within award of arbitrators proved by the oaths of Allen GRIST who proved the handwriting of the two Subscribing Witnesses thereto - the Said Subscribing Witnesses being out of the State & ordered by the court that the Same be Spread upon the Orphan Book containing divisions of Estates for said county.

Green County   ) We the undersigned William W. HILL, Thomas H. DAVIS & Joseph B. STICKNEY, do hereby certify that under & by virtue of a certain agreement made on the 30 day of December AD 1836 by William L. Kennedy - George A. FARRIS and Shadrach P. Allen, Acting by his attorney John G. HARVY - by which said agreement we were appointed commissioners and arbitrators for the purpose of making a fair & Equal division of certain negroes belonging to the estate of William Kennedy dec'd between the said parties to the said agreement, we have in pursuance of the said agreement and by the powers therein granted to us this day appraised and affixed a valuation to each of said negroes twenty Eight in Number as therein stated and did thus proceed to divide

the said negroes unto three lots as nearly Equal as the case would permit having relation to the valuation so affixed as follows lot No one containing the following named negroes at the prices affixed - Cesar 1300 dollars - Achilles 1200 dollars, Montalbert 1000 dollars Emperor 600 dollars,Chancy 750 dollars, Marior 750 dollars, Lucinda 700, Sally 100, Ned of no value - being nine negroes amounting to six thousand four hundred and fifty dollars - said lot receiving from Lot No. two to be hereafter named - the sum of Eight dollars & thirty three & a third cents for Equality of division, lot No. two containing Men Elaus 1350 dollars, Jim 1200, Ovid 900, Walter Scott 800, Aggy 600, Ansley & child Marian 900, Sarah 500, Rose 250, Dublin of no value, being ten negroes Amounting to Six thousand & five hundred dollars the said lot paying to Lot No. one the sum of Eight dollars & thirty three & one third cents - and to lot No three to be here after named the Sum of thirty three dollars & thirty three & one third cents for equality of division.

 Lot No. three containing Virgil 1350 dollars, Jack 1300, Swan 900, Archilles 675, Silvia 650, Harriett 900, Henry 500, Eve 150, Nanny of no value being nine negroes amounting to Six thousand four hundred and twenty five dollars and Said Lot receiving from Lot No. two before named the sun of thirty three dollars and thirty three & a third cents for equality of Division - which said three Lots & divisions we then distributed to the said three legatees by Lot as follows Lot No. one to George A. Farris - Lot No. two to the said Shadrach P. Allen and Lot No three to the said William L. Kennedy and do award that the alottee of Lot No. two shall pay to the other two allotters the amount herein before named as to be paid to them respectively which said proceedings and this our final decree making distribution of the said negroes - we do hereby report to the said legatees as by the said agreement we are directed Given under our hands & Seals this the 31 day of December AD 1836.
